SEXUAL HARASSMENT AT WORKPLACE








As provided within the Supreme Court guidelines (Vishakha & Ors vs. The State of Rajasthan) sexual harassment includes such unwelcome sexually determined behavior as:

Physical contact, a requirement or request for sexual favor, sexually colored remarks, showing pornography, the opposite unwelcome physical, verbal or non-verbal conduct of a sexual nature, as an example, leering, telling dirty jokes, making sexual remarks a couple of person's body, etc. It moves into the harassment domain when it isn't consensual. Harassment is usually called sexual assault too. Since there are just the principles handling the problem, thus, an Act was passed namely “The harassment of women at Workplace (Prevention, Prohibit, and Redressal) Act, 2013”.

Sexual harassment at the workplace means something which matches against the dignity of the woman and outrages her modesty and the Right to work during a secure environment could also be a constitutional right governed under Article 14 & 21…of the Constitution of India.

ACT FOR SEXUAL HARASSMENT AT WORKPLACE

In India, it's the harassment of girls at the Workplace (Prevention, Prohibition and

Redressal) Act, 2013 “Act”, which deals with harassment at the workplace. The objectives of the said law are as under:-

The Act will confirm that ladies are protected against harassment within the least the workplaces, be it public or private. This may contribute to the realization of their right to gender equality, life and liberty, and equality in working conditions everywhere. The sense of security at the workplace will improve women's participation in work, leads to their economic empowerment and inclusive growth.

The Act seeks to provide a secure and enabling environment for girls’ employees, including domestic workers, against harassment at the workplace. The Act makes it mandatory for all workplaces, including homes, universities, hospitals, government, and non-government offices, factories, other formal and informal workplaces to constitute an inside committee for redressal of complaints.

PREVENTIVE MEASURES to prevent SEXUAL HARASSMENT AT WORKPLACE

1. All staff should understand what's meant by harassment.

For example-Unwanted jokes, gestures, offensive words on clothing, and unwelcome comments

Touching and therefore the other bodily contact like scratching or patting a co-worker’s back, grabbing an employee around the waist, etc.

2. Your organization should publish a harassment at work policy and ensure all staff is conversant in it.

3. The most effective sort of prevention is awareness. Those that are aware of behavior that can be interpreted as harassment are less likely to behave therein way and more likely to notice any kind of harassment.

4. All staff must feel comfortable reporting any behavior that creates them or other staff feel uncomfortable.

5. Any instance whereby a fellow staffer or employee shares a priority with you ought to be addressed as soon as possible.
