Rape

  

Rape generally refers to crime against women. According to law, rape is a type of  sexual assault initiated by one or more person against another person without that person's consent. The act may be carried out by physical force or by threat or manipulation to a person who is incapable of valid consent. 

There are many cases in India regarding rape 

One of the landmark case was – Nirbhaya rape case 

This case created a lot of buzz in India. All of us are aware of the case facts, where a girl was brutally gangraped. And she got justice only after after 7 years. What was the reason for the delay in justice? Lots of pending cases on SC's head? Political Pressure on the lawyer and family members of the victim? There are actually a lot of reasons. Anyhow, at last she got justice. 

Even minor girls are raped by their own relatives.  At the age of 6-7 which is the age to play, study, relax and enjoy their lives, they suffer from physical and mental pain. 

Male rape :- 

And when we talk about rape, we only consider women who suffer under it, but the male too are affected by sexual assault and harassment.

A boy of 13 years of age, was sexually assaulted and later was forced to change his gender by giving hormonal medicine. The boy was so much traumatized by the event. Not only this, a lot of men out there suffer from sexual assaults. 

Rape laws:- 

Section 375 of the IPC made punishable the act of sex by a man with a woman if it was done against her will or without her consent. The definition of rape also includes sex when her consent has been obtained by putting her or any person in whom she is interested, in fear of death or of hurt.

Also, sex with or without her consent, when she is under 18 years of age is considered as rape. However, under the exception, sexual intercourse or sexual acts by a man with his wife, the wife not being under 15 years of age, is not rape.

Section 376 provides seven years of jail term to life imprisonment to whoever commits the offence of rape.

Conclusion:- 

The courts and the legislature have to make many changes if the laws of rape are to be any deterrence. The sentence of punishment, which normally ranges from one to ten years, where on an average male convicts escapes with paying a fine amount or punished just with three to four years of imprisonment.
